Short answer

A Committee on Government Assurances is a parliamentary committee that tracks promises ministers make on the floor of the House. In India, the Lok Sabha committee scrutinises assurances, promises and undertakings given by ministers and reports how far they have been implemented 1. An assurance must be fulfilled within three months of the date it was given 1. Ministries can ask for more time or ask the committee to drop an assurance 1. Similar committees sit in Zambia, Ghana, Kenya and Uganda 6,87,9.

What counts as an assurance

India's Ministry of Parliamentary Affairs describes assurances as statements by ministers on the floor of the House in the form of promises, undertakings or similar expressions, often made when information is not yet to hand 3. It keeps a standard list of expressions that count as assurances and says other remarks may be treated as assurances on the basis of the context 3.

The Lok Sabha committee's working manual, quoted in its reports, says an assurance arises when a minister gives an undertaking that involves further action by the government in reporting back to the House 1. The Ministry of Parliamentary Affairs extracts these from the proceedings and sends them to the department concerned through OAMS, normally within 20 working days 1.

How the Indian committees work

The Lok Sabha committee is nominated by the Speaker and was first nominated on 1 December 1953 3. The Rajya Sabha committee was first constituted on 1 July 1972 3. The committee manual links the Lok Sabha committee to Lok Sabha Rules 323 and 324 and the Rajya Sabha committee to Rajya Sabha Rule 211-A 1.

Both committees scrutinise the assurances, promises and undertakings given by ministers and report on how far they have been implemented and whether this happened within the minimum time necessary 3. The Lok Sabha committee for 2020-21 listed a Chairperson and 14 other members 2.

  • Deadline: an assurance given in either House must be fulfilled within three months 1.
  • Extension: the department asks for more time as soon as the need becomes apparent, with reasons and the extra time needed, through OAMS 1.
  • Dropping: a department that cannot implement an assurance must ask the committee to drop it, normally within a week, with prior approval of the minister 1.
  • Requests sent outside OAMS are not entertained under any circumstances, according to the committee manual 1.
  • The committee's decisions on these requests are treated as final 3.

What a committee report shows

Lok Sabha committee reports record the status of each assurance. The Eighty-Fifth Report of the 17th Lok Sabha, adopted on 25 July 2023, reviewed assurances pending with the Legislative Department of the Ministry of Law and Justice 1.

Item in the Eighty-Fifth ReportFigure
Assurances pending with the department 139, of which 4 dated from the 15th Lok Sabha, 17 from the 16th and 18 from the 17th 1
Taken up for oral evidence on 16 January 2023 126 1
Implemented, with reports laid on 8 February 2023 18 1
Dropped with the committee's consent 113 1
Still unfulfilled 15 1

When a committee refuses to drop an assurance

The committee can turn down a request to drop. Its Eighteenth Report of the 17th Lok Sabha, dated February 2021, is titled Requests for Dropping of Assurances (Not Acceded to) 2. It listed an assurance from an unstarred question of 8 January 2019 on comments on a Law Commission report, with the Ministry of Home Affairs, and one from a starred question of 14 December 2011 with the Ministry of Coal 2.

Indian state assemblies

State legislatures in India run their own committees. In Haryana, Rule 243 of the assembly rules sets the committee's functions and Rule 244 caps it at nine members nominated by the Speaker for one year 5. The Kerala Niyamasabha committee has no more than nine members as well, and ministers cannot sit on it 4. Kerala's Rule 258 says periodical statements showing reasons for delay are laid on the Table once in six months 4.

Committees in other parliaments

The Kenya committee may propose sanctions against a Cabinet Secretary who fails to report on implementation without justifiable reasons, according to its parliament page 7.
